Committee: Audit and Finance Committee
0:00 Of appearing virtually. Yeah, it is.
0:02 Yeah. You get talked about and don't even know it.
0:04 Uh, it, it's one o'clock.
0:06 So I will, uh, call to order the Austin audit and finance committee of the Austin City Council
0:11 for this special called meeting.
0:13 Uh, it's February 3rd, 2026. We are meeting in City Council chambers, which are located in City Hall, which is
0:19 at 3 0 1 west second street.
0:21 And we have a quorum.
0:23 We have all of the audit and finance committee present the, uh, Mayor pro.
0:27 Tim is joining us virtually.
0:29 Uh, with that being said, I will turn and ask if we have anyone signed up to speak
0:34 and call their name.
0:36 No, we do not.
0:37 Okay. Uh, very good.
0:40 Then we have no one signed to speak members.
0:41 That'll take us to the first item on the agenda was the approval of the minutes.
0:45 I have an addition that I wanna make to the minutes, and I must admit I didn't think
0:49 about it until I saw 'em here sitting on the di.
0:52 So with, uh, if there's no objection, I'll bring those to the next meeting of the audit and
0:57 finance committee, so we can add that.
0:59 'Cause I need to write something, uh, as a proposal, um, if that's okay with everybody.
1:03 What, and, and let me just tell you what it is.
1:05 We voted on an item, and I wanna make sure that the minutes properly reflect that there was
1:10 a vote on that item, and, uh, it just indicates that there was a discussion.
1:14 So I want, I want, I want to add to that.
1:16 Uh, with that being said, that'll take us to item number two, which is discussion and possible action
1:21 regarding a framework for developing a general obligation bond program.
1:25 That is the discussion about the decision tree members.
1:29 Um, uh, the other day I posted on the message board in response to, uh, things that I
1:37 just hear about in terms of questions and thoughts.
1:40 Uh, I posted two things, uh, on the, the message board.
1:44 One was an updated version of the, uh, proposed message, I'm sorry, proposed decision tree.
1:55 And in that, uh, working with the financial staff, we added a couple of things to it.
2:00 One is we added, uh, what was already existing policy of the city.
2:05 We also, uh, added the existing staff procedure.
2:10 And then where we made changes, uh, based upon comments that had been made by the audit and
2:16 finance committee and, and, uh, other comments that, that were out there.
2:21 We, um, we made some additional changes to this.
2:25 My guess is that today we will, uh, we will talk about some, some even potentially some more
2:30 changes. But that's the whole purpose of this, this, the meetings.
2:34 The other thing I did is I posted, uh, some general q and a related to, uh, the
2:41 potential decision tree. So I, I just mentioned those things as part of the, the part we're going
2:45 through with that, I'll open it up for discussion and let, but let me ask first if, um,
2:53 mr. Vino, do you have anything you want to add to what I just said or anything you
2:57 wanna say?
3:07 I don't, Mayor, but of course here, I'm here for, uh, any questions that might come up during
3:11 your discussion. Very good.
3:12 All right. Well then let me, uh, members, is there anybody who wants to start off this discussion?
3:19 Yeah. Council Member. Walter, thank you very much.
3:22 I really appreciate, um, the work that y'all both done on this.
3:27 I know this has been a, a team effort.
3:28 It has been. And being able to, you know, more concretely put down a lot of the questions,
3:34 I think a lot of us are asking and trying to figure out, uh, where we go with
3:38 this, when's the right time, the scope and all that.
3:42 Um, the big question I have for you, and, and we've had a little of this discussion at
3:48 previous meetings, it's the, the current financial policy that we have about not going for a bond election
3:56 unless there are two years or fewer of bonds remaining to be issued.
4:02 And I think at the, the outset, I, I, I think I mentioned at the last meeting, I
4:06 think this is a financial policy that needs some adjusting.
4:11 It's just on its face, not clear.
4:15 Given that I, I, at the last meeting, you, I was either you or someone mentioned that the
4:19 way we interpret that is 90% of the bonds, which is not actually what the financial policy says,
4:27 right? So it's like our policy is 90%, then it needs, the policy should say 90%.
4:32 Um, but also I just, I continue to have a concern around a particular department that May be
4:39 way behind and they might have four years worth of spend plan left and them holding up everybody
4:47 else. I think that's just a, a question we need to grapple with and figure out how we
4:51 roll that into the policy and, and minds May differ.
4:57 I I I think we just need to have a conversation around that.
4:59 And, and, and, and if it's all, if it's appropriate.
5:02 Yeah. Yeah. My, my my, uh, kind of instinctive reaction to that is that in preparing a proposed
5:13 decision making framework, and one of the first steps you would do is you will focus on what
5:19 are your policies, right?
5:21 Uh, especially when those po, the failure to follow those policies in a disciplined way May put the
5:31 current group of us into somewhat of a box.
5:35 Um,
5:40 and I'm gonna react in a couple ways.
5:42 One is that if we're gonna change the policy, then I think that ought to have us engage
5:52 in a discussion about the policy and maybe even set it separate from the framework for decision making.
6:02 Um, because I think that, that, there's been a lot of questions about how we go about that.
6:10 And that would allow us, I think, to have a more robust discussion about why you have the
6:17 policy,
6:21 what, uh, why you, what, what kind of exceptions you might have to the policy and why those
6:28 exceptions would be there.
6:29 And actually make it as a, as a, as a discussion about, uh, because for example, one of
6:36 the things the decision tree attempts to do is create an opportunity for an exception.
6:43 Um, it May not be the best word, it May not be the wording we end up with,
6:49 but it's, it's the idea that you would take into consideration.
6:52 We might be in, in different circumstances.
6:56 Uh, we would take into account the context in which you're making decision.
7:01 Um, but that's a policy decision.
7:05 That's not a, necessarily a framework decision.
7:07 So I, what I would recommend, or, or at least I'm, I'm thinking we ought to do, is
7:13 if we, if we're bothered by that in the decision tree, then we need to have a a,
7:18 a full discussion about the two years.
7:21 And I, I completely agree.
7:22 I think as we, you are clearly taking what exists today and, and putting it here, and I
7:28 think that makes complete sense.
7:31 And so either we do have that discussion about the policy itself, and you know, we've got three
7:38 weeks between now and the next to either start that discussion or this language could just point to
7:48 that policy. So if we do adopt the policy, it would kind of al automatically change, right?
7:53 So are, are the amount of bonds remaining to be issued consistent with financial policies?
8:00 That's a very, something like that.
8:02 Um, just kind of thinking out loud here, but well, I, I, I would like, and again, this
8:07 is just an idea.
8:08 This is not, I, I'm not beholden to this.
8:10 That's the reason we're having it as a, as a kind of a discussion is if we're going
8:15 to do this early enough in the year that it's meaningful, then probably the 26th is when we
8:21 need to do it.
8:23 Right? And so if we're going to make it as a recommendation from the audit and finance committee,
8:29 creating some language where the, but with the recognition in the motion, I think would be that we're
8:37 not gonna pass this unless we've had a full discussion about the policy and bring that we, we
8:46 won't have time. I'm not gonna try to have another special meeting.
8:49 The audit finance committee.
8:50 Yeah. But have a real discussion about that at some point before we then vote on this and
8:55 maybe even post that for that meeting.
8:57 But mr. Vino, we're doing a lot of your, uh, <laugh>, we're messing in your business.
9:02 So tell us what you think about all that.
9:05 Well, I, I, I do think that we do this every year.
9:07 Um, staff typically brings forward proposed tweaks and changes to our financial policies.
9:14 'Cause stuff changes, uh, best practices change.
9:16 And, and so every year staff will typically bring forward two or three policy, recommend policy change recommendations
9:22 to audit finance, to get your feedback, and then ultimately your recommendation for approval.
9:27 And then we incorporate those into the budget for ultimate approval by the City Council.
9:32 So this would be fully appropriate role for the, and, and, and, uh, historic traditional role for the
9:38 audit finance committee to take up an existing policy and to, uh, you know, seek to, to Alter
9:45 it. Okay. Um, yeah.
9:47 Okay. Well, other than that, I really appreciate, uh, the updates that, that you have made here, you
9:53 know, highlighting, uh, a few that I, I think are really important, that kind of minor.
9:59 But, you know, making sure our projects have environmental benefits associated with them.
10:03 That's something that's really important.
10:05 Uh, I know to myself and, and this council.
10:08 Uh, and then also really piggybacking on the discussions we had earlier today about how the city operates,
10:14 not, we wanna make sure that we're addressing deferred maintenance, because if things get more expensive, uh, both
10:22 to rebuild them, but if you invest in, let's say a facility or new or existing, that can
10:30 actually lower operational costs.
10:31 And that's something that, uh, we should always be conscious of as well.
10:35 So, um, just want to say, appreciate that being rolled in here.
10:41 I'd certainly love to listen to what everyone else has to say, and we'll go from there.
10:46 And, and just, I, we can take a stab at revising that policy just based upon what we've
10:51 heard today. I mean, off the cuff, uh, it's generally good to have your policies be clear, but
10:58 not overly prescriptive. The way staff will talk about it is substantial completion.
11:04 You know, we, we kind of have been quantifying that as 90% done, but in, in, in essence,
11:10 the bond program is substantially complete for any variety of reasons.
11:13 There could be a long tail to the final spending occurring.
11:16 You know, you can look at some of the tables, uh, kim, all of ours, who is gonna
11:20 share in a bit.
11:20 You'll see that there's a little bit of money still remaining from 2012.
11:24 That does not mean, and it should not mean, well, we still have, we still have bonds, you
11:28 know, remaining to be issued.
11:30 We shouldn't do, you know, so we really look at it in terms of substantial completion.
11:34 And that would be the kind of language here that maybe we, it would make sense to include
11:38 that in there, you know, two, two years of bond remaining, you know, and substantial completion of the,
11:43 of the bond program, uh, or something along those lines as opposed to prescribing 90 or 95 or
11:49 85%. Um, again, that's how staff has been interpreting this policy, but I think an addition like that
11:55 would, would be an improvement.
11:56 Great. And actually, I have one more.
11:58 And this is a really minor edit on the box.
12:01 Um, under the blue box, under the, no, does the proposed bond election meet the following emergency conditions?
12:08 Uh, just either a clarification in that top part or after the very first bullet, if it's an
12:13 and or an or just for the future.
12:18 It's a, I I, I believe it, it is meant to be as an and right now.
12:22 Okay. 'Cause I could, I, I'm just trying to think through, you know, if you have a significant
12:28 community need, but that it wouldn't have the federal or state, you wouldn't run a foul of state
12:35 or federal law would do.
12:36 We wanna think of those separately or together.
12:38 And that's, um, just a clarification was seeking.
12:42 And, and we'll, um, where are, where are you in the, the pink part, the, the box on
12:47 the left. Does the proposed bond election meet the following urgency conditions?
12:52 And then there's, you have the significant community need that cannot be addressed through non-voter approved debt or
12:59 basically reserves. And then a delay in funding, um, to, or delaying funding to address the identified community
13:06 need would result in non-compliance with federal or state regulation.
13:10 But, but that has an or in it too.
13:12 See, that's the different, uh, I, I get what you're saying, but there are three, there are three
13:17 elements to that. And not just federal or state.
13:20 Yes. Okay. I, I'm, I'm with you now.
