1:01 I'll call to order the Austin City Council meeting for July 23rd, 2026 at 10:00 in the morning. We are meeting in City Council chambers, which are located in City Hall at 301 west

1:13 second street in Austin, texas. And we have a quorum of the Austin city council president, as I call this meeting, to order. What I'll do, what we'll do first is we're going to we've got a very short meeting

1:24 today. So let me get that out of the way. But what I want to do is I'm going to walk you through what the order of business is going to be for the day. In a general sense. And then we will get right down to it.

1:38 In just a moment, I'm going to read changes and corrections into the record so that we have those. We will also then go to our consent agenda.

1:48 Members right now, the items that have been pulled from the consent agenda are item 68.

1:54 Items 15, 75, 76 and 142, I believe.

2:03 Item 86 is being pulled, but I'll confirm that shortly.

2:08 We will if somebody else has something else they want to pull, please let me know. We will then have a vote on the consent agenda and brief comments from

2:17 council members with regard to the consent agenda at some point after 1030 in the

2:22 morning. But as close as we can do it to 1030, we will have the Austin housing finance corporation board of directors meeting for the public public's information. What will happen is we will recess the city council meeting.

2:33 I'll call to order the board of directors meeting of hfc will conduct that meeting. Then we'll adjourn it, and we'll come right back to the City Council meeting. We have a number of non consent items other than those that have now been

2:44 pulled. But we have items from council. That's item number 91. We have three eminent domain matters items 92, 93 and 94. We have a number of public hearings.

2:55 Those are items 96 through 110 around noon.

3:00 We will have general public communication. What we will do is as close to noon as we can make it, wherever we are in the agenda. We will pause whatever we're doing, take up the 12:00 time certain of public

3:14 communication. We also have set a time certain at 230 for zoning matters.

3:19 We'll we'll figure out what we do when we get around to that time.

3:24 We will not be having music this week. Council Member so what will happen is we will just go straight from the general public

3:32 communication into other items on the agenda. With that, unless there are any questions or comments, let me read the changes and corrections. Yes. Councilmember walter. I know we're not having music this week. Today is a very special day.

3:44 It is. And I was going to get to that. Oh, okay. I didn't know that you were getting into business. Take it away. You're recognized. Well, there's a birthday down the way over here,

3:55 the José Velásquez. So just wanted to say happy birthday.

4:02 I'm not gonna sing. I'm. I'm gonna keep it in no music day. There you go. Mayor. I was just I was just excited that all these folks showed up on my birthday to see me. That's why.

4:11 Thank you all for being here. I appreciate y'all for real. That I trust. That's why they're here. And by the way, this suits older than José. So alright with that we will I'll, I'll read the changes of corrections in the

4:23 record. The item number 58 at the very end, it should read access easement across 13017

4:32 bob johnson road, unit b, and the word from should be put in there from

4:37 little bear orchards llc. And then continuing forward items items. 42653 And 70 have been withdrawn.

4:52 Items four, 26, 53 and 70 have been withdrawn.

5:00 The reason I emphasize that is if you're here to speak on items four,

5:05 26, 53 or 70, they have been withdrawn from the agenda,

5:11 so they will not be called up for you to speak on those items. So please make note of that. Again, I'll, I'll read again the items that have been pulled from the consent agenda. 14, 15, 7576 And 142. Item 68 and item

5:33 86. With that members, unless there's any other items that somebody

5:38 wants to bring up right now, what we will do is we will rapidly go into

5:43 our consent agenda, and we will start calling the speakers for the consent agenda.

5:47 And I will turn to the city clerk to please help us navigate that. Thank you Mayor. Starting with item number two. Bill bunch. On deck is item six, paul robbins and craig nasr.

6:06 If your name has been called, please come forward. We have a number of speakers today, and we want to be efficient with the speaker's time. So when she calls your name, don't wait in your seat.

6:16 Please come forward and take a seat if one's available so that we can be expeditious in

6:22 allowing you to testify. Mr. Bunch, you have the floor. Good morning, Mayor. Council members, thank you for your service to our community. Bill bunch executive director, save our springs alliance district five

6:35 resident for decades. This item is calling to move oversight of events in our public

6:44 parks out of the parks board and the parks department's hands and into the new culture,

6:53 music and entertainment world of the city's government.

7:00 We we oppose that. This is, you know, speaking loud and clearly that now

7:06 we're going to manage our parks for commercial profit making ventures.

7:12 Whether and some of those that are under the label of for profits, like the live nation ticketmaster monopoly that goes under the,

7:21 the, the local friendly rubric of Austin city limits and c three,

7:27 but it's really live nation ticketmaster. And then others that are view our parks as just a for profit money making enterprise.

7:39 Please keep this oversight in our parks so that we're managing our parks for as public

7:45 parks where we escape the city commercialization and a world of profit

7:52 making. First and foremost, with occasional special events.

7:57 Thank you for your consideration. Mr. Robinson, before you start, is greg nasr here? Okay. Four minutes for mr. Robbins. And what items?

8:08 This is on item six. Yes, Mayor, if you don't mind, mr. Robinson, if you don't mind, I'm going to ask legal to come up on item number five. Go, go. Sure.

8:20 Okay. Don't mean to upset you, mr. Robbins. Not upset. Okay.

8:27 Members. Item number five is a proposal for a settlement of a lawsuit. So I'm asking legal, and I want to take it in order. Please. Good morning, Mayor. Mayor Pro Tem. I don't think your speakers on.

8:43 Hello? There you are. Good morning. Mayor. Mayor Pro Tem council members. I'm assistant city attorney jeremy thompson, and I'm here today to recommend that you

8:53 approve a settlement payment in a personal injury lawsuit that appears as item number five on your agenda today. Item number five is mitchell versus city of Austin. We recommend that you approve a payment totaling $175,000 to settle the gregory

9:08 mitchell versus city of Austin lawsuit. This lawsuit relates to a December 2023 accident involving an Austin water manhole,

9:17 where the plaintiff seeks payment for injuries allegedly sustained in the accident.

9:21 In exchange for the payment, the plaintiff will release any and all claims against the city from the accident and will also dismiss his lawsuit filed in the

9:29 district court of travis county. The Austin city attorney's office recommends that you approve payment based upon these terms, and I'm available to answer any questions you May have. Thank you sir. Members do you have any questions at this time?

9:42 All right. Thank you, mr. Robbins. You now have the floor. Thank you for your patience. Good morning. Council. I want to start by with sincere thanks.

9:54 Last winter, resource management commission passed a resolution warning that residential

10:01 rate increases are. Austin energy recommended were affecting some City Council districts

10:10 more adversely than others. We recommended that if there were future rate increases, all rate components, including the base fee and four tiers be kept,

10:20 are raised at the same level to prevent future discrimination in rate increases.

10:27 And this appears to have happened in the new city budget. I do not know who in this room was responsible for this,

10:36 but I am grateful for your action. The item we're concerned with here is about battery storage, and you May be wondering how these two subjects of rates and battery storage combine

10:51 they relate because the commission I serve on is willing to investigate matters that Austin

11:00 energy does not normally tell the public. Austin energy will not discuss the economics of battery proposals that it brings to

11:11 council. Given our reputation for asking hard questions,

11:15 the utility is deliberately avoiding our commission.

11:21 The contract before you is $320 million over a 20 year period.

11:26 This is $300 for every person currently living in the service territory.

11:32 Maybe the investment will pay for itself. Maybe not. But Austin energy is intentionally being nontransparent council.

11:43 No one could expect that upon your election you would become immediate energy experts.

11:53 But we did elect you to be street smart.

11:58 If an agency is hiding basic information, it should raise your suspicion.

12:06 If you study the history of Austin utilities you know, there have been some major failures. The Austin dam cracked in 1900, only five years after it was built.

12:17 Because of poor engineering. The nuke was 460% over budget in eight years. Late in completion, a half billion dollar water treatment plant was built a generation

12:28 before it might be needed, but all of these were endorsed by the city's

12:33 experts in an effort to unravel the economics, I personally asked to see past solicitations and bids.

12:41 That is after the bid was awarded for batteries and Austin energy refuses to

12:48 provide even these. It's an educated guess that there was no bid to determine if the

12:55 city's ownership or pre-owned units might have been less expensive than this contract.

13:04 If this contract is such a great deal, why not boast about it?

13:11 In closing, I really do not want to come back here and say that I told you so.

13:19 But if you continue down the road of non-transparency, the odds of a bat in outcome increase.

13:27 Thank you. Thank you, miss robinson.

13:32 For item ten, I have kaiba white, then item 13,

13:37 stephanie hoffman and virginia palmer. Item 11. My apologies, katherine o'connor. Ma'am. What's your name, ma'am? What's your name? Rachel.

13:50 Doctor. Rachel. Scott. And what what item are you wanting to testify on? Item 11 and several others. Okay. Well, you didn't sign up for item 11.

14:02 Dogshit. I'm here for dogshit. Well, we're not dogshit. Item number 11 has been pulled. And so we're just doing the the 1111111 item 111 has been pulled.

14:16 And so we're not calling those yet. The way we do this is we call people's names in the order of the items that we're taking up on the consent agenda right now. Yes, sir. My my apologies. No problem at all. But would you like me to please.

14:29 That way the seats will be available for people who are on the island. I was misinformed, thank you. That's all right. Thank you. Miss white, you'll have the floor whenever you're ready.

14:42 Good morning. Mayor. Mayor Pro Tem council members. My name is kelly white. I'm speaking on behalf of public citizen's texas office. Sorry to be out of breath.

14:52 It was hard to get in here. I won't take a lot of your time, but. And I, you know, I expect you're probably going to pass this and approve the new agreement, but just did want to remind you all that the resource management commission

15:07 did make a number of recommendations as it pertains to the texas gas franchise.

15:12 And to my knowledge, I don't think really any of them have been executed.

15:17 A couple that I'll highlight are on leak detection and really ramping up the efforts

15:25 to do leak detection and repairs. I'm sure you all are aware that. Thankfully, I think it's mostly been in other cities. There have been a number of natural gas you know, distribution level pipeline and other system explosions and that have cost lives.
